SERVICE TERMS AND AGREEMENT
NOTICE TO THE PET OWNER/GUARDIAN: PLEASE READ CAREFULLY. THIS AGREEMENT INCLUDES A RELEASE OF LIABILITY AND WAIVER OF LEGAL RIGHTS AND DEPRIVES YOU OF THE RIGHT TO CLAIM AGAINST JESSICA RUIZ (REFERRED TO IN THIS AGREEMENT AS “PEPPER’S PACK PET CARE” and/or “THE DOG WALKER”), AND RELATED PARTIES. DO NOT SIGN THIS AGREEMENT UNLESS YOU HAVE READ IT IN ITS ENTIRETY AND UNDERSTAND ITS EFFECT, POLICIES, PROCEDURES, PET RELEASE, WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNIFICATION AGREEMENTS.
The Pet Owner will provide all required muzzles, harnesses, jackets and collars.
The Pet Owner agrees to the following terms and conditions:
✦ The Pet Owner agrees to provide the Dog Walker with all necessary instructions for the Dog Walker’s duties.
✦ The Pet Owner will provide any medication or special needs instructions for each of their pets.
✦ The Pet Owner will be considered liable for any damages or injuries caused by the pet(s) while under the care of the Dog Walker.
✦ The Pet Owner will pay Pepper’s Pack Pet Care at the applicable service indicated on the current fee schedule (rates subject to change).
The Dog Walker agrees to the following terms and conditions:
✦ The Dog Walker will perform the duties listed by the Pet Owner to the best of her ability, in a reliable and caring manner.
✦ The Dog Walker will keep secure and confidential any keys, pass codes, access numbers and personal information, and return them at the end of the contracted service date.
✦ The Dog Walker will supply and be equipped with a pooper scooper and disposable waste bags.
✦ The Dog Walker will not be liable for any injuries to the pet(s) that are caused by animals or people outside of the Dog Walker’s control.
✦ The Dog Walker will not be liable for any incident that occurs during transportation of the pet(s) to a vet, kennel or clinic.
✦ The Dog Walker agrees to abide by all municipal animal control by-laws.
Pet Requirements:
I represent that my pet meets all of the following requirements:
➣ is current on his/her required vaccinations.
➣ has been in good health for the last 30 days.
➣ is not human aggressive.
[1] Health. I represent that my pet has not had any contagious illnesses of any kind for 30 days prior to the start of service date. I am aware and understand that Pepper’s Pack Pet Care is not a veterinarian and does not have a background in animal medicine. Pepper’s Pack Pet Care cannot diagnose or detect illnesses in the client’s pet(s) and I agree to assume all risk associated with the administration of medication by Pepper’s Pack Pet Care. I acknowledge and am aware that vaccines do not protect against all contagious illnesses that may affect my pet. I HEREBY AGREE TO INDEMNIFY PEPPER’S PACK PET CARE, IT’S OWNERS, DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS AGAINST ANY CLAIMS MADE AGAINST PEPPER’S PACK PET CARE, IT’S OWNERS, DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS AS A RESULT OF MY FAILURE TO INFORM PEPPER’S PACK PET CARE OF ANY PRE - EXISTING MEDICAL CONDITIONS THAT MY PET MAY HAVE.
[2] Fleas and Ticks. I agree that Pepper’s Pack Pet Care provides reasonable care and supervision, though may not notice if my dog has fleas or ticks and I may therefore not be notified.
[3] Veterinarian Liability and Care. I agree to allow Pepper’s Pack Pet Care to obtain veterinarian medical treatment for my pet, if, in its sole discretion it appears that the pet is ill, injured, or exhibits any other behavior that would suggest that my pet might need medical treatment. Medical treatment may require transportation of my pet to receive care and I hereby authorize such transportation. I grant Pepper’s Pack Pet Care full authority to make decisions involving the medical treatment of my pet if attempt(s) by Pepper’s Pack Pet Care to contact me and/or my emergency contact are not successful. Every effort will be made to contact the Pet Owner prior to obtaining emergency care. I agree that I am fully responsible for the cost of any such medical treatment and transportation. I agree that I am assuming all risk of illness, disease, harm or otherwise to my pet by allowing my pet to participate in services with Pepper’s Pack Pet Care. I agree that I am assuming all risk of the consequences associated with any decisions made by Pepper’s Pack Pet Care relating to the medical care and transportation of my pet.
[4] Transportation. I agree that if my pet is transported to or from Pepper’s Pack Pet Care by its employees or agents that I AGREE TO HOLD PEPPER’S PACK PET CARE, IT’S OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS, HARMLESS IN THE EVENT OF INJURY OR ACCIDENT DURING TRANSPORTATION.
[5] Pet Behavior. I agree to be solely financially responsible for any and all acts or behavior of my pet while in the care of Pepper’s Pack Pet Care, WHICH MAY INCLUDE PAYMENT OF DAMAGES FOR THE INJURY CAUSED BY MY PET TO OTHER ANIMALS, HUMANS, AND/OR PEPPER’S PACK PET CARE. IN ADDITION, I AGREE THAT IF MY PET IS INJURED BY ANOTHER PET, I HEREBY RELEASE PEPPER’S PACK PET CARE, IT’S OWNERS, EMPLOYEES, AND AGENTS FROM ALL LIABILITY AND FINANCIAL RESPONSIBILITY FOR SUCH INJURY. I FURTHER UNDERSTAND THAT IF MY PET BITES A HUMAN OR PET, PEPPER’S PACK PET CARE MAY CONTACT THE APPROPRIATE AUTHORITIES.
[6] Pack Walks. I understand that Pepper’s Pack Pet Care may be utilizing pack walks, where multiple dogs are walked together and interact. I understand that dogs play with their mouths and paws, which can result in nicks and scratches on my pet. While Pepper’s Pack Pet Care provides reasonable care and supervision in the pack walks, I understand and agree that Pepper’s Pack Pet Care may not notice these nicks or scratches, and therefore I might not be notified. Pepper’s Pack Pet Care will look your dog(s) over before and after each walk and make a note of anything out of the ordinary.
[7] TLC Visits. During TLC Visits, Pepper’s Pack Pet Care will feed and give your pet(s) fresh clean water, clean the litter box, take your dog out for a walk/potty break and administer any medication as directed by the pet owner or veterinarian.
[8] Boarding. The Pet Owner agrees to the following conditions for boarding:
(a) No vaccines, no boarding: For the safety of your pet and other pets, Pepper’s Pack Pet Care will not board any animals without full updated vaccination records. The following vaccines will need to be current in order to board:
✦ Rabies
✦ DHLPP
✦ Bordatella
(b) The Pet Owner represents that the pet has not been exposed to rabies or distemper within 30 days prior to boarding, and will provide updated vaccination records from their veterinarian prior to the first date of boarding.
(c) No pet who has experienced ringworm, internal parasites (roundworms, heartworms, tapeworms, whipworms and hookworms) or fleas, ticks or lice may board without a veterinary note indicating the animal has been free and clear of infection for at least 30 consecutive days. The Pet Owner will advise of any other medical or physical conditions.
(d) The Pet Owner will advise Pepper’s Pack Pet Care of any allergies the pet has, and will provide the necessary food and/or medication required for the duration of the stay. On a case-by-case basis, Pepper’s Pack Pet Care will, at its sole discretion, administer medication under the direction of the Pet Owner at no extra charge.
(e) If the pet shall, in any form, become ill or the state of the animal’s health otherwise requires attention, Pepper’s Pack Pet Care, at its sole discretion, is authorized to engage the services of the veterinarian indicated on the New Client Registration Form. If listed veterinarian is unavailable, Pepper’s Pack Pet Care has the right to attend another veterinarian up to $5000 at the Pet Owner’s expense. If a veterinarian determines that emergency treatment, which exceeds the authorized amount, is needed to save the animal’s life or quality of life, and Pepper’s Pack Pet Care cannot reach the Pet Owner or the Emergency Contact, Pepper’s Pack Pet Care may authorize the veterinarian to perform the emergency treatment. The Pet Owner agrees to be responsible for all veterinary costs provided to the pet.
(f) The Pet Owner will provide, in writing, the drop off and pick up dates and times to Pepper’s Pack Pet Care at least 24 hours prior to the first day of boarding. For the purposes of billing, a day is defined as a 24 hour period starting from the time of drop off (i.e. 9:00 am Friday to 9:00 am Saturday is considered one full day). Pick up beyond that 24 hour period will be considered a new billing day (i.e. drop off at 9:00 am Friday with pick up after 9:00 am Saturday would be considered a second billing day).
(g) Emergency boarding services may be offered at the sole discretion of Pepper’s Pack Pet Care.
(h) All dogs who board at Pepper’s Pack Pet Care must be crate trained. The Pet Owner is responsible for providing the crate and enough food for the duration of the stay. Washable blankets, toys, special belongings, leashes, harnesses, jackets, etc. are welcome as long as they pose no threat to the pet. Pepper’s Pack Pet Care assumes no financial responsibility for the condition of their return or loss.
(i) The pet will receive a minimum of 2-3 walks per day, the frequency and duration of which will be determined on an individual basis as per a discussion between the Pet Owner and Pepper’s Pack Pet Care. The pet will also receive playtime and enrichment activities throughout each day of their stay.
(j) The Pet Owner will be held solely responsible for any and all acts of behaviour including aggression that take place during the stay.
(k) The Pet Owner warrants and represents that the pet is not a “show dog” or “show cat” and does not participate in dog shows or cat shows. The Pet Owner further represents that the Pet Owner generates no revenue or income from the pet’s performance. The Pet Owner does not intend, plan or anticipate that its pet will generate revenue or income in the future.
(l) The Pet Owner understands and accepts that the pet will not leave the premises of Pepper’s Pack Pet Care until all fees and charges are satisfied in full.
(m) The Pet Owner agrees that in the event the boarding charges are not paid when due in accordance with this agreement, Pepper’s Pack Pet Care may exercise its lawful rights upon ten (10) days written notice by delivering such notice via registered mail to the Pet Owner’s address. A pet that is unclaimed at Pepper’s Pack Pet Care for ten (10) days beyond its scheduled discharge date is considered abandoned and will become the property of Pepper’s Pack Pet Care. Every effort will be made to contact the Pet Owner if abandonment becomes an issue.
(n) If for any reason the pet is not going to be picked up on the scheduled dismissal date, the Pet Owner shall contact Pepper’s Pack Pet Care to make arrangements to extend the animal's stay and will pay the additional charges based upon the daily rate. If arrangements are not made to extend the stay, an additional charge of $40 will be applied on top of the daily rate for each additional day the pet is in boarding.
(o) The Pet Owner specifically represents that they lawfully own the pet listed on the New Client Registration Form to the best of their knowledge.
(p) Long-Term Boarding: any stays of four or more consecutive days will be considered a long-term stay and require a $100 deposit, due at the time of booking, to secure the spot.
a. Cancellations made more than 72 hours before the scheduled check-in date will receive a full refund of the deposit;
b. No-shows and Owners who cancel less than 72 hours before the scheduled check-in date agree to forfeit their full deposit;
c. Any cancellation request made outside of Pepper’s Pack Pet Care’s regular business hours will be considered as being received the following business day. This may lead to the loss of the deposit if it does not comply with the 72 hours notice requirement for cancellations.
[9] Inclement Weather. Pepper’s Pack Pet Care operates year round, except for rare instances of extreme inclement weather, i.e. thunderstorms / lightning, torrential downpours, blizzards, hazardous wind chill / humidex levels, or when the client’s usual walk route is made treacherous due to ice or heavy snow.
(a) Should Pepper’s Pack Pet Care be unable to reach your home due to poor weather conditions, Pepper’s Pack Pet Care will contact you by email, text message or phone to let you know the walk has been canceled. We will then refund your payment or place a credit for the dog walk back into your account.
(b) If we are able to reach your home in inclement weather, we will take your dog(s) out for a brief potty break and spend the remaining time playing indoors.
[10] Aggressive Dogs. Pepper’s Pack Pet Care accepts dogs that are aggressive towards other dogs or animals and are permitted to participate in services as private one on one walks only. Pepper’s Pack Pet Care does not accept any dog(s) that are aggressive towards humans.
[11] Photo and Video Release. I agree to allow Pepper’s Pack Pet Care to use my pet’s name and any images or videos taken while he/she is in the care of Pepper’s Pack Pet Care, in any form, for use, at any time, in any media, marketing, advertising, illustration, trade or promotional materials. Pepper’s Pack Pet Care will keep secure and confidential any keys, pass codes, access numbers and personal information.
[12] Personal Property. I agree that Pepper’s Pack Pet Care shall not be responsible or liable for any lost, stolen or damaged personal property belonging either to my dog or me.
[13] Keys: Pepper’s Pack Pet Care will obtain a copy of your house key(s) (or door code if applicable) after the initial consultation and services have been scheduled, and the agreement is signed. Key(s) will be returned in person within 2 days of the end of your service.
[14] Service Fees. Pepper’s Pack Pet Care reserve the right to discontinue service if payments are not made as scheduled. I accept cash and e-transfers only at this time.
(a) Prices and Availability - Pepper’s Pack Pet Care reserves the right to occasionally review and adjust the prices and availability of services.
(b) Payment - Payment in full is due as indicated on the invoice.
[15] Cancellations. Cancellations may be made up to 24 hours in advance of your scheduled service. Any payment already made will be credited to your account. Any services canceled on the day of scheduled services may be charged in full (at discretion of Pepper’s Pack Pet Care).
[16] Duty to Disclose. I, the Dog Owner, represent that I have disclosed and shall continue to disclose, any and all medical conditions or any other conditions, including, but not limited to, personality concerns or behaviors that may affect, limit, or prevent my pet’s ability to participate in services provided by Pepper’s Pack Pet Care. I understand that Pepper’s Pack Pet Care is relying on and will rely on those representations to provide a safe environment for both humans and animals.
[17] Waiver of Release and Indemnification. I RELEASE, WAIVE, DISCHARGE,INDEMNIFY AND AGREE TO HOLD PEPPER’S PACK PET CARE, ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS HARMLESS FOR ANY AND ALL MANNER OF DAMAGES, INJURY, CLAIMS, LOSS, LIABILITIES, COSTS OR EXPENSES, LEGAL FEES, COURT FEES, CAUSES OF ACTION OR SUIT, WHATSOEVER IN LAW OR EQUITY, ARISING OUT OF OR RELATED TO THE SERVICES PROVIDED BY PEPPER’S PACK PET CARE, ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS INCLUDING WITHOUT LIMITATION SUCH AS: ANY INACCURACIES IN ANY STATEMENTS MADE BY MYSELF OR INFORMATION PROVIDED BY ME TO PEPPER’S PACK PET CARE, ACTIONS OF MY PET, INCLUDING BUT NOT LIMITED TO DESTRUCTION OF PROPERTY, DOG BITES, INJURY, AND TRANSMISSION OF DISEASE, AND ANY ACTION BY MYSELF THAT IS IN BREACH OF THE TERMS OF THIS AGREEMENT.
[18] Sole Agreement. This writing represents the sole agreement between Pepper’s Pack Pet Care and the Dog Owner/Guardian.
[19] Affirmation. Each time I request service by Pepper’s Pack Pet Care, I am re-affirming the terms of this agreement, and the truthfulness and accuracy of all the statements I have made in this agreement. I HAVE READ AND FULLY UNDERSTAND THE TERMS OF THIS AGREEMENT. I HAVE SIGNED THIS AGREEMENT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE OR GUARANTEE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY PEPPER’S PACK PET CARE, OFFICERS, EMPLOYEES AND AGENTS TO THE GREATEST EXTENT PERMITTED BY LAW. I FURTHER AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID OR UNENFORCEABLE, THE REMAINDER OF THIS AGREEMENT SHALL REMAIN IN FULL FORCE AND EFFECT.
[20] Entire Agreement. Any violation of the aforementioned terms will be considered a breach of contract resulting in the termination of this contract and/or costs and damages payable by me to Pepper’s Pack Pet Care. The agreement is listed above in its entirety. There are no oral representations made outside of this contract. No oral agreements can be made to vary this contract. Any amendments must be in writing and signed by Pepper’s Pack Pet Care and I.
